Beth Modica, born as Beth Gardner, graduated from law school at St. Johns University and was dismissed from her job as assistant district attorney in Sloatsburg, NY where she lives, and as deputy town attorney in nearby Rampao, NY in late December.
The 44-year-old wife of the Spring Valley police chief Paul Modica and mother of 4 children was charged at a county court with having sex, smoking marijuana and drinking with at least four Hockey teammates of her 16-year-old son. But she had plead not guilty.
Former Rockland County (NY) prosecutor Beth Modica has plead not guilty to having sex with teens. She has also been accused of serving them alcohol and smoking pot with the teenage boys. The boys were hockey teammates of her 16-year-old son [who plays for the Suffern Mounties ice hockey team in Suffern, New York.].
She was charged on with five felonies: one count of third-degree rape, which is basically statuatory rape; and four counts of third-degree criminal sexual assault. She also faces 30 misdemeanor charges: four counts of third-degree sexual abuse and 26 counts of endangering the welfare of a child.
Beth Modica is alleged to have had sex with the 16-year-old and oral sex with the 15-year-old between July 1 and September 2.
The judge set bail at $75,000 due to the serious nature of the charges involving the minors. Modica would face a prison term of one and one-third to four years if convicted.
